What’s required to become - and remain - a compliant provider of Specified Accommodation, including how to apply, meet standards, and understand Housing Benefit rules
Specified accommodation is a term used in Housing Benefit rules to describe certain types of supported housing for people with care, support, or supervision needs.
To qualify, the accommodation must meet specific criteria and fall into one of four categories: Exempt Accommodation, Managed Property, Domestic Violence Refuge, or Local Authority Hostel.
Each category has different requirements for who provides the housing, the type of support offered, and how Housing Benefit is assessed.

The support given, must go beyond simple property management and has a real impact on your ability to live independently.

This is short-term accommodation, mainly for people fleeing domestic abuse. Abuse may be psychological, emotional, physical, sexual, or financial.
The landlord will be a not-for-profit organisation, and it will include on-site care and support services.
There is no requirement for support to be provided in this category.
This is housing which is owned or overseen by a local authority. The property should offer domestic living arrangements, though not in fully self-contained units. Tenants are required to receive more than minimal levels of care, support, or supervision. It must also provide either meal services or suitable facilities for residents to prepare their own food.
Supported accommodation plays a vital role in housing vulnerable individuals, and the number of providers has increased significantly in recent years.

All new providers must demonstrate they meet these requirements before accepting tenants, and all approved providers are subject to an annual review.

As the landlord, you must have a legal interest in the property concerned whether this be ownership or lease. You must also provide or arrange for care, support or supervision of your tenants, which is more than an ordinary landlord would provide.

Only if your application meets the criteria we will contact you to request the following additional information:
A Specified Accommodation Officer will assess your documents and rent structure. Your application will be discussed by the wider Supported Exempt Accommodation team.
The Specified Accommodation team will meet to review all the evidence and determine whether your scheme is suitable for Housing Benefit under the specified accommodation rules.
If approved, Housing Benefit can be awarded to tenants of the property accordingly.
You will be notified of the decision in writing.
Once accepted, you must regularly provide evidence that you continue to deliver appropriate care, support, or supervision to your tenants.
Failure to provide ongoing evidence or meet standards may result in your SEA status being withdrawn.
Once you are a recognised provider of Supported Exempt Accommodation, you can receive enhanced Housing Benefit rates, direct payments, and contribute meaningfully to meeting local housing needs.

Each of these charges must be clearly broken down and justified when applying for Housing Benefit.
All charges will be reviewed to determine if they are reasonable before they are included in the rental amount for the purposes of Housing Benefit.
It is your tenants responsibility to claim Housing Benefit. However, your involvement is crucial to ensure the claim is assessed quickly and correctly.
Housing Benefit will only be awarded to cover charges that are eligible, reasonable, and linked to the provision of adequate accommodation.
Clear and detailed evidence helps prevent delays or reductions in payment.
If a tenant’s Housing Benefit claim is rejected or the amount awarded is less than expected, the Council will send a decision letter to the claimant. This letter explains the reasons for the decision and the information used to reach it.
If the tenant believes the decision is incorrect:
The tenant can request that we look at the decision again. We will review the details and provide a written explanation confirming whether or not the decision has changed.
If the decision cannot be changed and you still believe it is wrong, an appeal can be submitted - but only the tenant can make this appeal. SEA providers are not permitted to appeal on the tenant’s behalf.
If an appeal is submitted, the Council will prepare the necessary paperwork and send it, along with the appeal, to HM Courts and Tribunals Service. A copy will also be sent to the tenant and the provider for reference.
The appeal will be reviewed by an independent tribunal, and HM Courts and Tribunals Service will set a date for the hearing.
It’s important that tenants and providers work together to ensure all information is accurate and submitted in a timely manner. Providing your tenant support during this process can be helpful, even though the appeal must be made by the tenant.

Brent Council’s approach to approving and monitoring Supported Exempt Accommodation (SEA) providers is aligned with the Supported Housing (Regulatory Oversight) Act 2023, which came into effect on 29 August 2023.
This legislation introduced national standards for support services and strengthened local authority powers to ensure supported accommodation is safe, suitable, and good value for money.
