Restricting promotions of products high in fat, sugar or salt by location and by volume price
From 1 October 2022, The Food (Promotion and Placement (England) Regulations 2021 introduces restrictions on the promotions and placement in retail stores and their online equivalents of certain specified foods and drinks that are high in fat, salt or sugar (HFSS) or ‘less healthy’ looking at volume prices, promotions and display locations.
This legislation is applicable to large businesses known as "Qualifying Businesses” who employs more than 50 employees and exceeding a floor area of 185.8 square metres (m2) or 2000 square feet (sq. ft.)
Placement
Sales of “less healthy foods” must not be displayed at store entrances, close to, or within 2 metres from the cashier (along the main customer route, including behind the cashier and at the end of aisle). Examples can be found in the links below.
Price and Volume Promotions
Less healthy foods and drinks sold as “buy one get one free, 50% off, 6 for the price of 4” or similar promotions are prohibited. Restrictions also apply for free-refills of sugar-sweetened beverages. The Price and Volume promotions section of this legislation has been delayed until 1 October 2025.
Qualifying on-line marketplaces
Qualifying on-line marketplaces must not display or place offers for sale of “less healthy foods” on their homepage, pop-ups, favourite product pages (recommendations). In addition, volume promotions cannot be offered on the website.
